GROUP COURSES

2. General
Our terms and conditions are exclusively applicable from the registration of the customer on our website www.berlitz.nl. This rule can only be by-passed by an explicit agreement signed by both parties.

3. Registration
The customer registers for the course of his/her choice by clicking the button 'booking'. By confirming the booking, the customer commits towards Berlitz to follow the course, subject to cancellation right in article 4. As soon as BERLITZ receives the booking, it will send the customer a confirmation e-mail with the description of the course.
The registration of the customer, as described in the confirmation mail of BERLITZ, commits the customer to following the course in the specified period and hours.

4. Cancellation
The customer has the right to terminate the agreement within 14 working days after receipt of the confirmation mail of BERLITZ. The cancellation of the customer must be sent to the BERLITZ SCHOOLS OF LANGUAGES BV, by registered letter to its headquarters at Weerdestein 205 A, 1083 GN Amsterdam. This is also the visiting address of BERLITZ. Any customer's complaints should be addressed here. If the cancellation is received within 14 working days following the confirmation mail of BERLITZ, the latter will refund already paid sums to the customer as soon as possible.

Past this period, or if the course has already started, cancellation is no longer possible, unless a fault can be attributed to Berlitz, and BERLITZ will not refund the price.

5. Features of the course
Each lesson will last 45 minutes including a 5 minutes break.
To ensure the quality of the lessons, the customer confirms he/she agrees with the possible presence of an educational adviser during some lessons.
Group lessons are held on the days and times defined by BERLITZ and cannot in any way unless in cases of force majeure for the customer, be postponed or refunded. During the first lesson an assessment test of fluency will be held, to ensure the student is allocated to the appropriate group.
In the interest of the students, BERLITZ may cancel or unite certain classes, if the number of participants is too low, or split up a class if it is too high. If the number of participants is lower than the required minimum number to start the chose course, BERLITZ will adapt the number of courses according to the number of participants.
BERLITZ can also transfer a student to another group, if it is better suited to his/her level.

6. Availability of teachers
To familiarise the students with various expressions, the teacher might change. There is no right to training by a specific teacher.

7. Price indication
The price of the course does not include the educational material that the customer will have to purchase at the first lesson. The prices indicated on the BERLITZ webpage are VAT incl., except for courses that are not subject to added value taxation.

8. Payment terms
BERLITZ invoices are immediately due. Any delay in payment will result in a late payment interest of 12 % per year and a fine of 15 % on the original sums due

9. Author's rights and educational material
The educational material published and supplied by BERLITZ is subject to author's rights and cannot be used or duplicated for commercial purposes, even partially, without prior written authorisation by BERLITZ.

10. Website and included websites of third parties
BERLITZ rejects any liability for non- or faulty accessibility of its website.
The website www.berlitz.nl may indicate websites of third parties. BERLITZ will in no way be made responsible for the content of those sites and the accuracy of the information they contain.

11. Guarantee and liability
BERLITZ rejects any liability for the non-achievement of the student's learning objectives. BERLITZ is only bound by an obligation of effort in this matter. The student shall attend the lessons with punctuality and commitment.
BERLITZ also rejects any liability, unless intent or intentional negligence by the BERLITZ management, for any loss, theft or damage to objects the participants bring to its premises.

12. Data protection
The customers' data are stored in the internal databases of BERLITZ, conform with legal provisions, to inform them about future courses that might be of interest to them. Customers who prefer not to remain informed, are requested to communicate this to BERLITZ by e-mail (info@berlitz.nl) with indication of their customer number.

13. Disputes
Any disputes resulting from or relating to the execution of this agreement will be settled by the competent judge of the Amsterdam region, unless Berlitz decides to summon the respondent before the competent judge of his/her place of residence. Dutch law applies to all judicial actions with or by Berlitz.

INDIVIDUAL COURSES
1. General
Our general conditions exclusively apply from the client's date of enrolment on our website www.berlitz.nl. This rule can only be deviated from on the basis of an explicit agreement by both parties.

2. Registration
The client enrols for the course of his choice by clicking on the 'enrol' button. By confirming his enrolment, the client commits himself vis-à-vis to Berlitz to take this course, subject to the cancelation right mentioned in Article 3.
As soon as BERLITZ has received the enrolment request, it will send the client a confirmation e-mail with a description of the course.
The client's enrolment, as mentioned in BERLITZ' confirmation e-mail, obliges the client to follow the course during the specified period and hours indicated.

3. Cancellation
The client has the right to cancel his enrolment within 14 days after receipt of BERLITZ' confirmation e-mail. The client's cancelation must be addressed to BV Berlitz Schools of Languages, by registered letter to the head office situated in Weerdestein 205 A, 1083 GN Amsterdam.
If the cancelation is received within 14 days following BERLITZ' confirmation e-mail, the latter will reimburse the amounts already transferred as soon as possible to the client, with deduction of €35 for administrative costs.
After this deadline or if the course has already started, cancelation is no longer possible and BERLITZ will not reimburse the amount paid.

4. The course
Each lesson lasts 45 minutes including a five-minute break.
In order to guarantee the quality of the teaching, the client declares to agree with the presence of an educational advisor during certain lessons.
The curriculum for the individual courses shall be determined by Berlitz and the client together, before the course starts.
Pupils may cancel or postpone certain lessons if they inform the secretary of the Berlitz centre by 2 pm 4 days before the course at the latest. Any private lesson that is missed without prior notice cannot be recuperated. After two successive absences without prior notice, the timetable that was provided for the private lessons may be suspended in the pupil's interest. Requests for changing the timetables of private courses must be addressed to the secretary of the Berlitz centre organising the course and shall be submitted to BERLITZ for approval.
Lessons that have not been followed may be reimbursed if requested by registered letter addressed to the BERLITZ centre that organised the course within six months after the start of the course and subject to a fixed administrative cost of €50.

5. Teacher availability
To familiarise pupils with different pronunciations, teachers are switched as much as possible. There is no right to be taught by a specific teacher.

6. Quotation
The price of the course does not include the pedagogical material which the client will have to purchase during the first lesson after taking a competence evaluation test. The prices mentioned on the BERLITZ website include VAT, except for lessons that are not subject to VAT.

7. Terms of payment
BERLITZ' invoices must be paid in cash. Any delay of payment will result in the application of interest in arrears of 12% annually and of a fine of 15% on the original amounts owed.

8. Copyright and pedagogical material
The pedagogical material published and supplied by BERLITZ is subject to copyright and cannot be used, in full or in part, or reproduced for commercial purposes without the prior written consent of BERLITZ.
The pedagogical material remains the property of BERLITZ, as long as it has not been fully paid for.

9. Website and third party websites
BERLITZ is not liable for access to its website.
The website www.berlitz.nl may mention third party websites. BERLITZ cannot be held responsible for the content of these sites and for the accuracy of their information.
10. Guarantee and responsibility
BERLITZ is not liable if the pupil does not reach the educational targets set. BERLITZ is only bound by an obligation to use its best efforts. The pupil undertakes to follow the lessons on time and to make an effort.
BERLITZ is also not liable in case of loss, theft or damage of objects taken to the classrooms by the participants.

11. Data protection
Client information will be filed in BERLITZ' internal files, taking account of legal stipulations, to be able to inform them about future courses that may interest them. Clients who would rather not be updated are asked to stipulate this to BERLITZ by e-mail (info@berlitz.nl) including their customer number.

12. Disputes
In the event of a dispute, only the Amsterdam courts are authorised and only Dutch law applies.

LANGUAGE CAMPS FOR KIDS & TEENS

1. General
Our general conditions apply exclusively from the client's date of enrolment on our website www.berlitz.nl. This rule can only be deviated from on the basis of an explicit agreement by both parties.

4. The course
The services rendered as part of the language camp are described on www.berlitz.nl. If one of the parts of the programme cannot be carried out due to force majeure (e.g. poor weather conditions), then BERLITZ reserves the right to provide a substitute programme. Cancelation of the camp due to changes in the programme is not possible.
No reimbursement is possible if a child voluntarily leaves the camp, after inappropriate behaviour or if it has become ill. If a child requires medical aid during the camp, then all additional expenses, such as transport to a doctor or a hospital or the purchase of medication must be reimbursed to BERLITZ by the parents or guardian after the first request for payment.
BERLITZ cannot be held liable for any damage suffered by a participant or third party, provided this was not caused by an error or serious negligence of staff recruited by BERLITZ. All responsibility for minor negligence shall be excluded. BERLITZ also cannot be held liable in case of loss, theft or damage of objects taken along by the participants.
The parents or guardian of a minor participant undertake to take out a family policy that covers the civil liability of the participant for any damage he or she may cause.
It is recommended not to take appliances and electronic games, jewellery and valuable objects to the camp.

Refund Policy

1.Our general terms and conditions are applicable exclusively as of the learner's enrolment. No exceptions may be made to these rules except by express written
agreement, signed by both parties.

2.Group courses will be held on the dates and times determined by Berlitz and may under no circumstances be postponed or reimbursed. Lessons falling on a public holiday will be brought forward. If the minimum number of participants for a group course is not reached, the course will not start and a reimbursement will take place within a maximum of 4 weeks. In order to habituate learners to a variety of pronunciations, teachers may be changed.

3. Fees for private and group courses are payable in advance at the time of enrolment. For companies, the invoice will be issued upon receipt of the purchase
order and will be payable cash.

4. If, however, some monies remain outstanding after the course start date, BERLITZ will have the right to claim, in addition to the principal, a penalty interest
of 12% per annum and to invoke the application of a penalty clause of 15% on the sums payable.

5. The rate applicable upon the date of enrolment remains in effect for three months. Beyond this period, outstanding lessons may be subject to adjustment to
take account of increased costs.

6. For private face to face courses, learners can cancel or postpone certain lessons provided they notify the school's planning office, by email only, before 2.00
pm on the last working day before the lesson in question. Private distance lessons can be cancelled or postponed at bvc@berlitzeu.com before 1.00pm on the
last working day before the lesson in question. No private class missed without notice can be recouped. After two consecutive absences without notice, the
scheduled timetable for the private lessons may be suspended, in the interests of the learner. At the request of the learner or his or her company, the value of
classes not taken may be transferred to any other school within the BERLITZ Group, notwithstanding the fact that the new school may apply a different rate.
Credit for classes not taken may also be reimbursed, provided that this is requested by registered letter within 6 months of the enrolment date and subject to
the deduction of administrative costs at the fixed rate of 40 Euros.

7. Face to face and distance group lessons will be held on the days and at the times determined by BERLITZ and may under no circumstances be postponed or
reimbursed. In the interests of learners, BERLITZ may withdraw or merge some classes if the number of participants is too low or, alternatively, split them if
numbers are too high. BERLITZ may also transfer a learner to another class if this is more commensurate with his or her level.

8. In order to habituate learners to a variety of pronunciations, teachers may be changed if the timetable permits.

9. All lessons (except for telephone lessons) will be of 45 minutes' duration, including a 5-minute break.

10. All private telephone lessons will be of 30 minutes' duration. Learners can cancel these lessons up to 6 hours before the start of the lesson, via the
Netplanning platform.

11. Any complaints relating to teaching materials must be sent by registered letter to BERLITZ within eight days of their delivery, under penalty of forfeiture of
entitlement. However, materials will remain the property of BERLITZ until such time as they have been paid for in full.

12. In the event of any dispute, the courts of the judicial district of Amsterdam will have sole jurisdiction and only Dutch law will apply

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
